(a) "Weesify" means the web platform and services provided by Weesify, including but not limited to link shortening, bio-link building, AI-generated content and images, QR code creation, and other web tools;

(b) "Website" means the Weesify website, located at www.weesify.com or any other URL that may replace it in the future;

(c) "User" means any individual or entity that accesses or uses the Weesify website or services, including but not limited to marketers, bloggers, influencers, and other professionals.

Use of Weesify

(a) To use Weesify, you must be at least 13 years old or the legal age of majority in your jurisdiction, and have the legal capacity to enter into these terms and conditions;

(b) You agree to use Weesify solely for lawful purposes and in compliance with all applicable laws and regulations;

(c) You agree not to use Weesify for any illegal, fraudulent, or malicious activity or to transmit any content that is infringing, offensive, or harmful.

Account Registration

(a) To access certain features of Weesify, you may be required to create an account and provide us with certain information about yourself, including but not limited to your name, email address, and payment information;

(b) You agree to provide accurate, current, and complete information and to update it as necessary to maintain its accuracy;

Disclaimer of Warranties

(b) We do not guarantee that Weesify will be uninterrupted, error-free, or free from viruses or other harmful components;

(c) We do not endorse, guarantee, or assume any responsibility for any content or products or services offered by third-party websites linked to or from Weesify;

(d) You agree to use Weesify at your own risk and to assume all responsibility and liability for any loss or damage that may arise from your use of Weesify.

Limitation of Liability

Termination

We may terminate these terms and conditions or suspend your access to Weesify at any time, with or without cause, upon notice to you. Upon termination, all rights granted to you under these terms and conditions will cease immediately, and you must immediately stop using Weesify.

We welcome feedback and suggestions regarding Weesify. If you provide us with any feedback or suggestions, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable, and transferable license to use, modify, reproduce, distribute, display, and disclose the feedback or suggestions for any purpose without restriction.

(a) We own all intellectual property rights in Weesify, including but not limited to the copyright, trademark, trade secret, and patent rights;

(b) You may not use any of our intellectual property rights without our prior written consent;

(c) You retain all intellectual property rights in any content you submit or upload to Weesify, but you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable, and transferable license to use, modify, reproduce, distribute, display, and disclose the content for any purpose without restriction.

User Conduct

(a) You may not use Weesify in any manner that violates any applicable law or regulation, or infringes upon the rights of any third party;

(b) You may not use Weesify in any manner that interferes with or disrupts the operation of Weesify or the servers or networks used to make Weesify available;

(c) You may not attempt to gain unauthorized access to any portion or feature of Weesify, or any other systems or networks connected to Weesify, or to any of the services offered on or through Weesify, by hacking, password mining, or any other means;

(d) You may not use any automated system, including but not limited to bots, spiders, or scrapers, to access Weesify for any purpose without our express written permission.

Prohibited Content

(a) You may not submit or upload to Weesify any content that is illegal, fraudulent, defamatory, obscene, pornographic, or otherwise offensive or inappropriate;

(b) You may not submit or upload to Weesify any content that infringes upon the intellectual property rights of any third party;

Disclaimer of Warranties

(a) Weesify is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of Weesify or the information, content, materials, or products included on or made available through Weesify;

(b) We do not warrant that Weesify will be uninterrupted or error-free, or that defects in Weesify will be corrected;

(c) We do not warrant that Weesify, or any part thereof, is appropriate or available for use in any particular jurisdiction.

Limitation of Liability

(a) In no event shall we be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of Weesify or with the delay or inability to use Weesify, or for any information, content, materials, or products included on or made available through Weesify, or otherwise arising out of the use of Weesify, whether based on contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of damages;

(b) In no event shall our total liability to you for all damages, losses, and causes of action arising out of or in any way connected with these terms and conditions or your use of Weesify exceed the amount paid by you, if any, for accessing Weesify.

Indemnification

You agree to indemnify and hold us, our affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these terms and conditions or your violation of any law or the rights of any third party.

Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Any action arising out of or in connection with these terms and conditions shall be brought only in the state or federal courts located in San Francisco, California.

Entire Agreement

These terms and conditions constitute the entire agreement between you and Weesify with respect to the use of Weesify and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Weesify.

Waiver and Severability

Our failure to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision. If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these terms and conditions shall remain in full force and effect.

Modification of Terms and Conditions

We reserve the right to modify these terms and conditions at any time, in our sole discretion, without prior notice to you. You agree to review these terms and conditions periodically to be aware of any changes. Your continued use of Weesify after such modifications will constitute your acknowledgment and acceptance of the modified terms and conditions.

Termination

We reserve the right, in our sole discretion, to terminate your access to Weesify, without notice and for any reason, including without limitation, breach of these terms and conditions. The provisions of these terms and conditions that, by their nature, should survive termination of these terms and conditions shall survive such termination.
